Terms of Use

APPLICATION DESCRIPTION
1. These Terms of Use are an agreement between HASHER COMPANY OÜ and the User. The Terms govern the provision of Services of the Application developed by HASHER COMPANY OÜ, Code 16917232, (hereinafter referred to as "HASHER WALLET", "Company", "we", "our", "us"), located at the following legal address: Harju maakond, Tallinn, Kesklinna linnaosa, Vesivärava tn 50-201, 10152. The Terms are governed by and construed in accordance with the laws of the European Union and come into force from the moment you click the "Register" button on the Application or from the moment you agree to the Terms of Use in the Application.
2. The Application is a software provider designed and intended to provide Users with the ability to access and use Digital assets that are stored on the blockchain. The Application is not registered as a bank or securities broker/dealer, is not licensed or approved by any government financial regulatory agency, and cannot be used as an individual investment advisor. HASHER WALLET does not have access to the Users’ personal information and Digital assets.
TERMS
1. User – a registered person using the Application and Services (hereinafter referred to as “you”, or “your”).
2. Application – software that provides access to Services related to the storage, use, receipt and withdrawal of Digital assets.
3. Services – Application services hosted and available to the User relating to the use and storage of Digital assets.
4. Wallet – an account created by the User to gain access to the Application Services.
5. Digital asset – an asset that exists in digital form, such as cryptocurrency, token, digital rights and others.
6. Seed phrase – a set of randomly selected 12 words formed into a phrase that can be used to restore access to the Wallet if it is lost.
USER CONSENT
1. Before using the Application, please read these Terms carefully. By using the Application and any part of the Services, the User agrees to comply with the requirements and rules outlined in these Terms. If the User does not provide his consent to comply with these Terms, HASHER WALLET cannot provide access to the Application Services to such User.
2. The User agrees and acknowledges that HASHER WALLET may revise the Terms or any part thereof. The updated Terms will be publicly available on the pages of the Application. Notifications of changes will be sent to the User registered in the Application by email or in the form of electronic notification. Use of the Application after such notification and/or publication constitutes acceptance of the amended Terms by the User. The version of the Terms currently displayed on the Application supersedes all previous versions.
3. The User agrees to receive electronic notifications and messages, push notifications. Such consent is valid on an ongoing basis until the User revokes it. The User may revoke such consent at any time by sending an electronic notification. Notifications and messages may be sent to the User's Wallet or by email.
4. You agree that HASHER WALLET has the right to request information that will help us identify and verify your personality. The Company has the right to suspend your use of the Application if you do not provide the requested information or if the provided information is considered inaccurate or incomplete.
5. Users agree that by using the Application, they are not residents of a sanctioned jurisdiction pursuant to trade embargoes, United Nations Security Council resolutions (“UNSC”), or the financial sanctions regime of the United States Department of the Treasury, and Users are not currently an object or a subject to economic sanctions, such as the United Nations Security Council Sanctions List, OFAC's Designated Nationals List, the U.S. Commerce Department's Denied Persons or Entity List, or any other similar list maintained by any other relevant sanctions authority.
6. Users agree that by using the Application, they are not residents of a sanctioned jurisdiction pursuant to trade embargoes, United Nations Security Council resolutions (“UNSC”), or the financial sanctions regime of the United States Department of the Treasury, and Users are not currently an object or a subject to economic sanctions, such as the United Nations Security Council Sanctions List, OFAC's Designated Nationals List, the U.S. Commerce Department's Denied Persons or Entity List, or any other similar list maintained by any other relevant sanctions authority.
AGE LIMIT
1. The Application is intended exclusively for Users who are over 18 years old and/or authorized representatives of legal entities. The use of the Application by minors is prohibited. HASHER WALLET does not bear any responsibility for any consequences that may arise from the use of the Application by minors.
2. By agreeing to the Terms, you confirm that you are an individual who is at least 18 years old and/or an authorized representative of a legal entity, and have the right to enter into this agreement.
RISK NOTICE
1. Users agree that they are solely responsible for their activities with Digital assets in the Application and are aware of the risk of losing such Digital assets at any time. HASHER WALLET provides software using which Users receive the ability to access and use Digital assets that are stored in the blockchain. HASHER WALLET does not store Users’ Digital assets.
2. HASHER WALLET does not provide investment, financial advice or consulting services, we are solely a multi-currency crypto wallet provider. By using our Services, you understand and agree that the materials posted on the Application are for general informational purposes only. The information contained in the Application does not constitute a recommendation regarding any specific investment, security, portfolio, transaction, investment strategy and/or advice regarding transactions in Digital assets. Decisions on concluding transactions or performing operations with Digital assets are made by Users independently and within their capabilities.
3. You also understand and agree that advising Users regarding the nature, potential, value or suitability of any particular cryptocurrency, stock, security, investment portfolio, transaction, investment strategy or other matter is not part of the HASHER WALLET Services. Accordingly, the User may not contact us for personalized investment advice that we do not provide.
USER REGISTRATION
1. To use the HASHER WALLET Services, the User must register the Wallet in the Application and undergo identification. To register, the User needs to create a secret code and repeat it, then create a Seed phrase from the proposed words and a backup copy of such a phrase. We provide Users with the opportunity to copy the Seed phrase for storage outside the Application. To continue the registration procedure, the User must provide consent to the notification about the risks of losing the Seed phrase, and also undergo verification of the correctness of the Seed phrase by duplicating it.
2. During the registration process in the Application, the User can import an existing cryptocurrency wallet. This will allow you to manage your Digital assets that were previously created and/or located in another application.
3. After registering in the Application, the User can go to the main page of the Wallet, where the Services will be available, Digital Currency wallets and the User’s accounts will be displayed.
APPLICATION SERVICES
1. Storage. HASHER WALLET provides Users with secure digital wallets designed for storing, transferring and carrying out other transactions with Digital assets. The Wallet provides a connection between third parties and blockchains, allowing the User to carry out actions with Digital assets.
2. Deposit, withdrawal, exchange and transfer of Digital Assets. The user can carry out transactions with Digital assets that are stored in his Wallet. Once transactions, such as deposits, withdrawals, exchanges and transfers of Digital assets, have been sent to the network, they cannot be cancelled. For any Digital asset transaction to be completed, it must be processed and confirmed on the public blockchain associated with the Digital asset.
3. Purchase of Digital assets for fiat funds, replenishment and withdrawal of fiat funds. The User may purchase and/or sell Digital assets using a credit or debit card. HASHER WALLET provides the opportunity to use the services of third parties who will convert the amount selected by the User into a Digital asset and credit it to the Wallet and/or withdraw the Digital asset into fiat funds and credit it to the credit or debit card that is assigned for such a transaction.
4. Broadcasting information about the value of Digital Assets provided by third party Providers. Users have access to information about the rates and costs of Digital Assets according to data imported from the exchange, which is the HASHER WALLET service provider.
5. Loyalty program and Cashback. From time to time, Users may receive discounts and/or deferred discounts refundable to the User on Application Services and/or third parties’ services. The validity period, size and conditions of such discounts will be posted in the Application. The use of a loyalty program for the Services means the User’s full agreement with the terms of such a loyalty program.
6. HASHER WALLET does not control blockchain networks and third parties, therefore, we do not guarantee that any transactions you submit using the HASHER WALLET Services will be confirmed and processed.
SUPPLIER SERVICES
1. HASHER WALLET provides Users with the opportunity to access third parties’ services and products of third parties, whose services are integrated into the Application. List of third parties:
  1. SAMSUB. The Platform verifies Users and transactions. By using this third party’s service, you agree and accept the Terms of Use and the Privacy Policy located at :https://sumsub.com;
  2. WhiteBIT. The cryptocurrency exchange is integrated into the Application for trading Digital Assets. By using the service of this third party, you agree and accept the Terms of Use and the Privacy Policy located at :https://whitebit.com/ua;
  3. MoonPay. The payment system for exchanging Digital assets for fiat and fiat funds for Digital assets. By using this third party’s service, you agree and accept the Terms of Use and the Privacy Policy located at :https://www.moonpay.com;
  4. UTORG. The payment system for exchanging Digital assets for fiat and fiat funds for Digital assets. By using the service of this third party, you agree and accept the Terms of Use and the Privacy Policy located at :https://utorg.pro;
2. HASHER WALLET and third parties are independent contractors and are not agents of each other. All third parties act on their behalf; the use of the third parties’ services by Users is carried out exclusively between the User and the third party.
3. HASHER WALLET acts as an intermediary between Users and third parties when Users use the services of third parties. HASHER WALLET Services are limited to the technical provision of a user interface for the provision of third parties’ services.
4. When Users use the services of third parties and interact with them, they must familiarize themselves with the Terms of Use and Privacy Policies of such third parties. The User is responsible for complying with and understanding the Terms and Privacy Policies of any third parties.
5. HASHER WALLET does not control and makes no representations or warranties regarding any third parties’ services. Users access such third parties’ services at their own risk.
6. HASHER WALLET is not a party to any transactions between Users and third parties, and also does not receive any payments from Users for the third parties’ services, according to this, HASHER WALLET is not financially responsible to Users for any refunds and does not have the authority to make decisions on rates and/or commissions that arose in connection with the use of the third parties’ services.
TAXES. COMMISSIONS
1. When interacting with a Digital Asset system and/or network, Users' Digital Asset transactions may involve fees that are required by such systems and/or networks. You must ensure that your Wallet balance is sufficient to complete transactions before you conduct a transaction.
2. Users agree that HASHER WALLET is not responsible for failed transactions or losses that may arise in the event of insufficient funds for a transaction and/or incorrect transaction fees, as HASHER WALLET does not have access to any Users’ transactions.
3. Users are responsible for compliance with tax obligations as determined by local law and applicable to the use of the Services. The Company is not responsible for determining and complying with the Users’ tax obligations.
4. Users are responsible for determining the type and amount of taxes. If any applicable to transactions for which you have provided transaction details through the Application, you are responsible for reporting and remitting the correct tax to the appropriate tax authority
REFUND
1. Since HASHER WALLET does not accept commissions or payments from Users for the provided Services, we do not offer cash refunds and are not responsible for refunds for Services provided by third parties, as we do not process or have access to information about your transactions and commissions paid. If you require a refund, please contact the applicable third parties whose services you used. A list of third parties whose services are provided by the Application is available in the "Third parties" section of the Application.
2. Please note that third parties may have restrictions on refunds. All exchanges for fiat currency and Digital Assets are final and non-refundable. Payments and fees for made transactions are non-refundable and cannot be changed once the transaction is completed and the Digital Asset is sent to the Wallet address specified by the User, so it is important to check the Wallet address and/or credit or debit card details before conducting the transaction.
3. Refunds of any transactions are subject to the third parties’ Terms of Use. Only those transactions that were not successful are subject to refund. Refunds cannot be issued in cases of incomplete or incorrect data provided by Users and/or in cases of data inconsistencies and/or other suspicious circumstances. In the event of a refund, return fees may be charged. The amounts of return fees are posted in the Terms of Use and/or on the third parties' resources.
4. In case of transactions that violate the law and/or the rules of the Application and third parties, the last may freeze fiat funds or Digital Assets for a detailed investigation. If Users intentionally block or reject transactions suspiciously, third parties have the right to freeze such transactions.
BACKUP DATA STORAGE
1. HASHER WALLET does not store or collect private keys from User Wallets. Backing up your Wallet address, Seed Phrase and private key pairs associated with your Wallet outside of the Application will allow you to access the blockchain network on which your Wallet is secured and/or restore access to the Wallet without losing Digital Assets.
2. If the User has not created a backup copy of his Wallet data and/or private key pair outside the Application and has lost access to the Digital Assets located in the Wallet, such User agrees to be solely responsible for the loss of access to the Digital Assets.
USER GUARANTEES
1. Users agree and warrant that they will not violate any local or international laws that apply when using the Application Services. You will not:
  1. engage personally and/or induce any third party to engage in activities prohibited by these Terms;
  2. use the Application Services to pay for, support or otherwise engage in any illegal activity, such as illegal or prohibited trade, illegal gambling, fraud, money laundering or terrorist activity, arms sales and drug trafficking;
  3. use or attempt to use another User’s Wallet;
  4. use the HASHER WALLET Application in any way that may negatively affect or prevent other Users from fully using the Application;
  5. take actions that may create an unreasonable or destructively large load on the Application; circumvent or attempt to circumvent any measures we use to restrict access to the Services; violate, misappropriate or infringe upon the rights of HASHER WALLET and Application Users, including privacy, publicity, intellectual property or other proprietary rights; distribute viruses or harmful computer code through the Application.
2. The User will use the Application Services only in jurisdictions where it is permitted. You agree not to use the Services if you are located or are a resident of a jurisdiction where the use of the Application Services and/or HASHER WALLET at its discretion is prohibited and/or illegal.
3. By using the Application, you confirm the provision of true and accurate information about yourself when registering a Wallet or using the Services. If it changes and/or if such information is not accurate and current, you must update your information.
4. You are responsible for security and inaccessibility to any third parties of the device you use to access the HASHER WALLET Services. To receive the Services properly and securely, you agree and undertake to:
  1. not leave devices and/or data which you use to log into the Application on your behalf accessible to third parties and do not provide third parties with access to the device and/or such data;
  2. provide optimal security measures for your device used to receive the Services, such as installing anti-virus and anti-spyware software, and firewalls. The list of measures is not exhaustive.
5. The User has no right to hold HASHER WALLET liable for any damage that may arise as a result of the use or non-use of the Services. This includes, but is not limited to financial and business losses. This clause applies to all Services posted in the Application.
6. If you are using the HASHER WALLET Services on behalf of an entity, you represent and warrant that the entity is duly organized and operating in accordance with the applicable laws of its jurisdiction, and that you are duly authorized by such entity to act on its behalf.
VIOLATION OF APPLICATION RULES
1. If the User violates these Terms, HASHER WALLET, in its sole discretion and with prior notice, may at any time limit, change or discontinue, temporarily or permanently, any part of the Application Services.
2. HASHER WALLET does not block or limit the storage of Users’ Digital Assets in the Application. If the use of the Application Services is restricted for the User, you will be able to withdraw your Digital Assets to external wallets.
3. HASHER WALLET may implement controls to restrict Users' access to the Services in any jurisdiction prohibited by these Terms. In this case, the User's access to the Application Services may be suspended.
4. Access to Digital Assets in your Wallet, following restriction or suspension of access to any part of the Services, will be conditioned on your access to a backup copy of your Wallet address and private key.
TERMINATION OF USE OF THE APPLICATION
1. These Terms are valid as long as the User's Wallet is active. You may terminate your Wallet and these Terms by deleting your Wallet at any time at your discretion. Before deleting the Wallet, the User must withdraw all Digital assets to external wallets.
2. If the Wallet was deleted at the request of the User, Digital assets that were not withdrawn before deletion remain on the blockchain. The User can restore such a Wallet using a secret code and Seed phrase. In case of loss of the secret code and Seed phrase, access to Digital assets will be irretrievably lost, since HASHER WALLET does not store the User’s data.
USER SECURITY AND PRIVACY
1. Security. To create safe conditions for using the Application Services, the User, when filling out the registration form, creates a password and Seed phrase, biometric protection and a code for the Application. You will keep your password and Seed phrase secret and will not share it with anyone. In the event of loss of access to your Wallet, unauthorized use of your Wallet, or any known or suspected security breach, including loss, theft or disclosure of a password and/or Seed Phrase, the User should contact HASHER WALLET support by email at support@hasherwallet.io .
2. Confidentiality. We are committed to protecting and maintaining the confidentiality of the Users’ personal data provided to us, to this end, we have implemented appropriate policies and technical measures to protect data under our control from unauthorized access, improper use or disclosure, modification, destruction and loss, in accordance with the GDPR provisions. You can view the HASHER WALLET Privacy Policy by following the internal link. HASHER WALLET's Privacy Policy applies to your use of the Application.
3. Users acknowledge that for privacy, security and other reasons, their data, in the original form, received by HASHER WALLET, may be deleted without backup after such data has been processed to provide the Services.
4. While the User Wallet is active, you grant HASHER WALLET the right to use, transfer, store and backup your data, namely: transaction/exchange/sale/purchase history of Digital Assets, to provide the Services as specified in the HASHER WALLET Terms of Use and Privacy Policy.
INTELLECTUAL PROPERTY
1. The HASHER WALLET Application contains software, designs, content and trademarks that are protected by international copyright and other applicable laws. Unless otherwise noted, HASHER WALLET is the exclusive copyright owner of such materials and trademarks.
2. Users do not have any rights or interests in or to this Application and its materials other than the right of access solely for personal use in accordance with these Terms and subject to all copyright and other proprietary notices.
3. Your use of the HASHER WALLET Application does not give you any rights, title or interest in or to the HASHER WALLET intellectual property. You agree not to infringe the copyright of the Application, including but not limited to, you warrant that you will not, in whole or in part, copy, reproduce, modify, republish, publish, distribute, collect, sell, license, create derivative materials and/or in any other way to use the intellectual property of HASHER WALLET.
DISCLAIMER
1. HASHER WALLET is not responsible if the User uses the Application while located or being a resident of a jurisdiction where the use of HASHER WALLET Services is prohibited. Any use of the Application in a jurisdiction where access to the Services is prohibited is the personal responsibility of the User.
2. HASHER WALLET does not guarantee the availability of the Application. We are not responsible for what may happen if the Application is unavailable to the User at any time. In addition, HASHER WALLET cannot guarantee that the Application will always be free from destructive or defective elements. Users agree not to hold or attempt to hold HASHER WALLET liable for any technical problems, failures or malfunctions in the Application, communication line failures, software failures and/or loss of data, access or bandwidth problems of the Application, high Internet traffic demand, security breaches and unauthorized access, and other similar problems and deficiencies, including access problems on the part of the User.
3. HASHER WALLET does not represent or warrant that Users will be able to access or use the Services at any time or location they choose, or that HASHER WALLET will have sufficient capacity to provide the Services generally or in any geographic location. HASHER WALLET makes no warranties of any kind with respect to the Services, including warranties of informational suitability or applicability for a particular purpose.
4. HASHER WALLET assumes no liability for failure, damage or destruction of computer systems, Users' data or records and/or any part thereof, or for delays, losses, errors or omissions resulting from failure.
5. HASHER WALLET does not represent or warrant that User Support will provide uninterrupted or error-free services.
6. HASHER WALLET is not responsible for any consequences or losses arising from the provision of incorrect User data.
7. HASHER WALLET is not responsible for any loss or damage caused by the User's reliance on information obtained from the Application. You are solely responsible for your own investment decisions and transactions. Before selling, exchanging, withdrawing and/or purchasing Digital Assets, Users must conduct their own research and due diligence on such solutions.
8. HASHER WALLET is not responsible for determining whether taxes apply to Users' transactions or for collecting, reporting, withholding or remitting any taxes arising from any transactions related to Digital Assets.
9. HASHER WALLET is not responsible for any consequences arising from the User's use of the integrated services of the third parties. If you require assistance with a third party, you must contact that third party directly, but HASHER WALLET Support will assist you if possible.
10. By using the Services, you may be exposed to offensive, indecent or objectionable content. HASHER WALLET is not responsible for such content as it does not distribute or use such content.
11. HASHER WALLET makes no representations whatsoever regarding any third-party content contained in or accessible through the Application. Any terms, conditions, warranties or representations associated with such third-party content are solely between Users and the providers of the third-party content.
JURISDICTION. COMPLIANCE WITH LOCAL REGULATIONS
1. HASHER WALLET undertakes to comply with the current legislation of Estonia, regardless of the location of the Users. The Terms and relations of the parties will be governed by the current legislation of Estonia. If any provisions of these Terms are inconsistent with any applicable law, those provisions will be superseded or modified only to the extent such provisions are inconsistent.
2. Users are responsible for compliance with local laws regarding the use of the Application Services and regulations regarding the use of Digital Currencies in the jurisdiction of the User's registration.
3. Users waive any objections arising and based in connection with personal jurisdiction, residence, sanctioning jurisdictions, or inconvenience of the Application.
4. The parties agree to resolve any disputes arising in connection with these Terms or the use of the Application Services on an individual basis.
5. The parties agree that any arbitration will take place in Tallinn and choose the Court of Arbitration at the Estonian Chamber of Commerce and Industry to resolve disputes.
6. The arbitration will be conducted confidentially, by a single arbitrator in accordance with the rules of the International Commercial Arbitration Court at the Estonian Chamber of Commerce and Industry, in the English language and with limited disclosure.
7. The prevailing party in a dispute arising under these Terms of Use is entitled to costs and attorneys' fees.
8. The arbitration decision may be enforced in court according to the User's jurisdiction.
9. Users agree that any claims that may arise in connection with the use of the Application must be filed within 3 (three) months after such claim arose. If the deadline for filing a claim has expired, your claim will be rejected, regardless of its content.
ADVERTISING IN THE APPLICATION
1. The Application may contain links and advertisements to third-party websites or resources. HASHER WALLET does not control third-party websites and is not responsible for the availability or content of third-party websites. When visiting external links, Users must review the Terms of Use and Privacy Policies of such third-party websites or resources. It is the User's responsibility to comply with and understand the Terms of Use and Privacy Policies of any third-party websites.
2. The Application may contain advertisements and promotional offers from third parties or other service providers. The User has the right to refuse the transfer of personal data and personalization of advertisements. Your interactions with third-party websites and promotions, and any terms, conditions, warranties or representations associated with such interactions, are between you and such third party.
3. HASHER WALLET is not responsible for data sent by Users to public areas via external links. The data you submit through external links has not been verified and/or approved by HASHER WALLET.
4. HASHER WALLET reserves the right to delete data submitted or posted by you in public areas without prior notice.
USER SUPPORT
1. HASHER WALLET provides support to its Users. By agreeing to the Terms, you have the right to contact the HASHER WALLET support service at any time by sending an email to support@hasherwallet.io and/or going to the Telegram, and LiveChat messengers, links to which are posted in the Application. To apply, the User must provide his User ID. The reason for the request may be:
  1. any questions regarding the Services provided to you and suggestions for improving them;
  2. appeal if any Application Services are unavailable to you;
  3. errors or other problems in the operation of the Application.
2. Once your message is delivered, the support team will review it within 24-48 hours. The response time of the Support service is not set; depending on the quality of your message or the detection of a violation of the Terms, the Support team has the right not to respond to your request.
3. To get answers to general questions about using the Application, such as the loyalty program, payment systems and transactions with cryptocurrencies, the User can use the FAQ section.
4. When contacting the Support Service, be honest, send only truthful information, do not be rude, do not use offensive words, be polite and friendly, and do not violate private and public human rights.
5. Please also note that we are not responsible if any User or third party writes to you on behalf of HASHER WALLET for any information they request from you. Please be careful and make sure you are contacting HASHER WALLET support. User support is provided only by contacting by email at support@hasherwallet.io and/or via Telegram, LiveChat messengers, links to which are posted in the Application.
GENERAL TERMS
1. These Terms imply the complete understanding and agreement between HASHER WALLET and the Users with respect to the Application. You agree to rely only on these Terms.
2. If part of these Terms is invalid, or for any reason unenforceable, that part will be deemed severable and limited from the rest of these Terms and will not affect the validity, legality and/or enforceability of any other parts or provisions of the Terms.
3. Users agree that HASHER WALLET may assign and/or subcontract any rights under these Terms without any notice or consent from the User.
4. Users may provide public feedback on the Application, and HASHER WALLET may copy, disclose, license, distribute and use User feedback without any obligation or restriction based on intellectual property rights or otherwise. Users’ public reviews will not be considered confidential information.
5. Your agreement to the Terms is your personal consent, and you do not have the right to transfer or assign it to third parties.
